Do I Need a Council Permit to Remove a Tree in Melbourne?

One of the most common questions we get at TLSC is, "Do I need a permit to cut down this tree?" In Melbourne, the answer is usually yes, but it depends entirely on your local council and the specifics of the tree in question.

The General Rule of Thumb

While every council has its own Local Law or Planning Scheme, you will generally need a permit if your tree meets any of the following criteria:

  • Height: The tree is over 5 to 8 metres tall.
  • Canopy: The canopy spread is greater than 5 metres.
  • Trunk Circumference: The trunk circumference is greater than 50cm to 150cm (measured at 1 to 1.4 metres above ground level).
  • Significant Landscape Overlay (SLO) or Vegetation Protection Overlay (VPO): Your property is covered by a planning overlay that protects vegetation.
  • Native Species: The tree is an indigenous or native Australian species.

Exemptions: When You Might Not Need a Permit

There are some common exemptions where a permit may not be required:

  • Dead Trees: If the tree is entirely dead (this usually requires confirmation from a qualified arborist).
  • Immediate Hazard: If the tree poses an immediate risk to life or property (e.g., after a storm). You must usually provide photographic evidence and an emergency arborist report.
  • Weed Species: Certain declared noxious weeds or environmental weeds (like some Willow or Privet species) are often exempt.
  • Proximity to Dwellings: Some councils allow the removal of trees if they are within a certain distance (e.g., 2-3 metres) of an existing dwelling.
